To strengthen the capacities of the Regional Development Council (RDC) – CAR Secretariat, the National Economic and Development Authority (NEDA) – CAR conducted a Seminar Workshop on Preparing Legal Documents last June 22, 2016 at the RDC Hall, Botanical Garden.

The activity, a follow through activity to the training“Preparing Resolutions and Understanding Legislative Processes” conducted last March 7, 2016, aimed to reinforce the capacities of the RDC- CAR Secretariat in rendering effective services to the RDC specifically on preparing legal documents for RDC programs and projects such as the SPCAR.

Atty. Roumelia B. Alpasan- Base of the Legal Research and Compliance Division, NEDA Legal Staff, lectured on Legal Documents, its forms and contents.

One legal document covered was the contract. She discussed its essential requisites, such as consent, object certain, and cause, and emphasized that the absence of the essential requisites will invalidate a contract.In a contract, parties may stipulate but it should not be contrary to law, customs, morals, public policy and public order, Base added.

She also highlighted that in drafting a contract, such as a Memorandum of Agreement (MOA), Memorandum of Understanding (MOU), Affidavits, Contract of Service or any other form of contract, it is important to be clear, specific, concise and consistent with the provisions especially on the rights and responsibilities of each party.

Atty. Kit Saqueton- Antonio also underscored the importance of verification and certification of non- forum shopping. She said that these two are separate processes but they should be taken into consideration because some cases that have been filed were technically dismissed by reason of non- verification and non- certification.

As a final note, Atty. Jocelyn Reyes urged the NEDA-CAR staff to send legal documents and contracts to the central office for review.
